New Delhi: Legally, even after divorce, the husband is obliged to take responsibility for the maintenance of the wife. The Supreme Court heard a case and said that religion cannot create obstacles in the field of maintenance. The Supreme Court has given such a verdict regarding the rights of Muslim women.
According to information, a Muslim woman from Telangana and her husband Muhammad Abdul Masad got divorced in 2017. The woman claimed maintenance from her husband under Section 125 of the CrPC.
However, Justice BV Nagaratna and Justice Augustin Garg Masih heard it. According to section 125 of CrPC, even after divorce, the husband is obliged to take responsibility for the maintenance of the wife. In addition, the court has ordered Abdul to support his wife at the rate of 20,000 rupees per month.
The Supreme Court also said, Indian men should recognize the desertion of their wives. No religion can hinder the fertility of women. Not only Muslim women, women of all religions have the right to maintenance.
